For a first DUI or DWAI conviction or for a second DUI or DWAI conviction in a lifetime but more than 5 years ago, alternatives to a jail sentence are allowed. This can include options such as work release, home detention, treatment attendance.

For a second DUI or DWAI conviction within a 5 year period or a third DUI conviction in a lifetime, No sentencing alternatives are allowed; however, if at the time of sentencing a work release program exists in the county (yes, El Paso County Colorado has a work release program) and the defendant is either enrolled in school, employed, enrolled for level II treatment, or receiving medical treatment then the defendant can be sentenced to work release for the purpose of attending work, school, or treatment.

For a fourth DUI conviction in a lifetime there are no sentencing alternatives.
