Our client was charged with Felony Sexual Assault. The alleged victim was extremely intoxicated and claimed our client took advantage of her at the party when she was unable to consent to sex because she was too drunk. Our client vehemently denied this allegation, claiming the alleged victim not only consented but also initiated the sexual contact. During a three-day trial, Kimberly skillfully cross-examined the alleged victim and elicited testimony from her that her motivation for bringing these allegations was financial and/or sympathy from her mother. The detective who investigated the allegation admitted to many flaws and contamination in the case that all favored the alleged victim. After Kimberly’s presentation of the true facts in the case, the jury saw through these falsified allegations and found our client Not Guilty. A member of the jury commented to Kimberly after the verdict, “You ran circles around [the prosecutor].” The client’s case was sealed by the court, and he treated himself to a trip to Hawaii the day after the jury acquitted him.

Case Dismissed, Expert Barred from Testifying
Our client was charged with Felony Sexual Assault on a girl he was dating while they were at a party. The prosecution wanted to bring an “expert witness” in sexual assault victim dynamics to testify at trial against our client. Kimberly and Joe researched the proposed expert witness and the expert’s claimed area of expertise and found it to be well below the legal threshold.
